Texas GOP Leaders Agree: TCCA’s Ruling Would Allow Rampant Voter Fraud”

Thankfully 14 Texas Senators (led by TX Sen. Paul Bettencourt) along with Texas Attorney General Ken Paxton and Lt. Gov. Dan Patrick have all objected to the disastrous ruling from the Texas Court of Criminal Appeals (12.21.21) and have asked the (TCCA) to reconsider its ruling.

The TCCA’s ruling would allow election fraud to go uninvestigated by the Texas Attorney General (TAG) which is exactly what George Soros wants:  To give “cover” to election fraud so that Texas could be turned Blue.  

I wrote four articles (12.21.21 – 12.29.21) to draw attention to the disastrous TCCA ruling. I have posted the links to my four articles further on down the page.  

We must share this very important information with any and all Texans.  Nothing is much more serious than the ramifications of the TCCA ruling which could easily allow election fraud to run rampant. George Soros’s “bought” district attorneys would have the power to stop the TAG from investigating election cheating; Texas could easily be turned Blue in every election throughout the state.

THE MAIN TALKING POINTS OF THE TX. SENATORS’ 1.19.22 AMICUS BRIEF:

The amicus makes three points.

First, there is no issue of separation of powers between the Attorney General and district attorneys.

Second, not allowing the Attorney General to prosecute these cases dilutes our legislative authority.

Third, the Texas Constitution requires the Legislature to write laws that detect and punish voter fraud.”

As the Texas Attorney General has had the authority to prosecute certain election law violations for 70 years, the Senators ask for a rehearing of the case. If the court does not reconsider its opinion in Stephens v. State and Ex Parte Stephens, election integrity cases will be left exclusively to being prosecuted by local county and district attorneys.”

 

AMICUS BRIEF BY FOURTEEN TEX. SENATORS – TX. CONSTITUTION – DETECTING AND PUNISHING VOTER FRAUD

Houston, TX - Senator Paul Bettencourt (R-Houston), along with Senators Birdwell (R-Waco), Buckingham (R-Lakeway), Campbell (R-New Braunfels), Creighton (R-Conroe), Hall (R-Edgewood), Hughes (R-Mineola), Kolkhorst (R-Brenham), Nelson (R- Flower Mound), Paxton (R-McKinney), Perry (R- Lubbock), Schwertner (R-Georgetown), Springer (R-Muenster), and Taylor (R-Friendswood) filed an Amicus Brief with the Court of Criminal Appeals of Texas arguing that they should grant a rehearing of case Stephens v. State and Ex Parte Stephens.

 

"This is an important legal case to be considered for a rehearing by the Court of Criminal Appeals," said Senator Bettencourt. "The fact that fourteen Texas Senators signed the amicus brief puts a real point on it," he added.

BACKGROUND OF THE TAG’S ELECTION FRAUD CASE AGAINST SHERIFF ZENA COLLINS STEPHENS

The case stems from the Texas Attorney General’s Office prosecuting Sheriff Zena Collins Stephens once the FBI was informed of information "regarding potential campaign-finance violations," according to the court filing.

The information was relayed to the Texas Rangers. Their investigation came to the conclusion that Stephens received individual cash campaign contributions in excess of $100.

As a result, the Attorney General's Office prosecuted Stephens by charging her on three counts, two counts of unlawfully making or accepting a contribution and one count of tampering with a government record. In April of 2018, she was indicted on all three counts. The case has been appealed.

The latest result was the Texas Court of Criminal Appeals reversing the appellate court's decision and, in doing so, the Attorney General of Texas cannot prosecute criminal cases independently in the state of Texas.

 

 

As stated by Tex. Lt. Gov. Dan Patrick on 1.25.22:

Election integrity is one of the most important tenets of our government, and we need checks at the state level to ensure that our elections are fair. Nearly 70 years ago, the legislature determined that the power to prosecute election-related crimes should not be left solely in the hands of local elected officials. I ask that the Court of Criminal Appeals rehear the case at issue and uphold decades of precedent that allowed the legislature to delegate prosecutorial power to the Attorney General to enforce election laws.”

Lt. Gov. Patrick continued, ”If the court’s decision stands, certain rogue county and district attorneys will be allowed to turn a blind eye to election fraud, and they will have the final say on whether election fraud is prosecuted at all. To me, this is completely unacceptable.”

On 1.26.22, Gov. Greg Abbott stated, "Texas passed the nation's strongest election-integrity law to make it easier to vote and harder to cheat, cracking down on voter fraud…Texas' highest law enforcement officer has constitutional authority to enforce that election-integrity law."
